Terms of Service
CONFIDENTIALITY, NON-DISCLOSURE & PERSONAL DATA PRIVACY
At Progressive Computer Solutions, your privacy and the confidentiality of your data are our top priorities.
We use your personal information solely to provide service updates and process your order. We may also use it internally for auditing, research, or to improve our services and technologies. We do not share your personal details with any third parties.
When you entrust us with your hard drive or device, rest assured that your business or personal data will remain strictly confidential. Access is restricted exclusively to the technician(s) assigned to your case, and all recovered data stored on our systems is encrypted. Once you have received and confirmed your recovered data, any copies stored during the process are permanently deleted.
We take every possible measure — both digital and physical — to ensure your data is protected while in our care.
DATA RECOVERY SERVICE TERMS & CONDITIONS
1. Authorization
The client authorizes Progressive Computer Solutions and its agents to evaluate the submitted media to determine the extent of the damage and provide a cost and turnaround estimate. This evaluation is free, and no charges will be incurred without the client’s explicit approval.
By submitting media, the client affirms they are the legal owner or authorized representative of the owner of the data and device. The client agrees to indemnify Progressive Computer Solutions from any third-party claims related to the data or equipment provided.
2. Unclaimed Property
Devices left unclaimed for more than 30 days may be recycled or disposed of. Progressive Computer Solutions assumes no liability for unclaimed property after this period.
3. Limited Liability
Data recovery is not guaranteed. Progressive Computer Solutions is not liable for:
Loss or damage to equipment or media
Condition or presence of data before, during, or after service
Loss of data, revenue, or any consequential damages
Maximum liability is limited to the amount paid for the services.
3.1 Exclusive Remedy
If data recovery is unsatisfactory, Progressive Computer Solutions may:
Attempt further recovery at no additional cost, or
Issue a refund (at its discretion)
Clients acknowledge the inherent risks in data recovery — including the possibility of further damage or non-recovery — and accept these risks. Recovered data will be retained for 10 days following delivery; after that, all copies will be destroyed unless otherwise requested.
4. Confidentiality
We will not disclose any data provided, stored, or recovered to third parties, except to authorized employees, contractors, legal counsel, or agents under confidentiality agreements — or as required by law.
5. Payment
Payment is due in full before any recovered data is released (via shipment, pickup, or download), unless previously arranged otherwise.
Successful recovery is defined as restoring data that was previously inaccessible.
Partial recoveries are still billable unless agreed otherwise.
The client is responsible for all shipping, customs, and taxes to and from our facility.
We accept all major credit cards and company checks (with a 5-business day clearance period). Personal checks are not accepted.
6. Warranty
Progressive Computer Solutions provides no express or implied warranties. All services are provided “as-is,” and any warranties — including those of merchantability or fitness for a particular purpose — are expressly disclaimed.
